0.0 This is the EULA ("End-User License Agreement") between you and LowPolyCube. It regulates how LowPolyCube makes the software available to you and on which basis you may use it.
0.1 By using any software produced and/or published by Dario Bloch (in following called "LowPolyCube"/"LPC"/"owner"/"I"/"me"), you agree to these End-User License Agreement and the Terms & Conditions for software use of LPC-applications.
0.2 The person using these kinds of sowftare will in following called be called "user", "you", "he".
0.3 This EULA does apply to, including but not limited to, applications, entertainment software and utility software ("software").
0.4 For software that is currently in either an alpha or beta stage, the user also accepts the specific "Terms & Conditions for Beta-Testing" and "Terms & Conditions for Alpha-Testing" respectively.

1. Scope of the License

1.1 You are granted a non-exclusive, non-transferable, non-sublicensed, non-commercial and personal license to install and/or use the product, for such time until either side terminates this EULA.
1.2 You may not reverse engineer, redistribute, nor reuse any artwork, pictures, pieces of code etc. that are not specifically marked for reuse. Exceptional cases may be
a) code snippets, that are distributed under certain Creative Commons Licenses or other such licenses; and
b) artwork, pictures, audio and other such media that are distributed under certain Creative Commons Licenses or other such licenses.
A list of all CC0 and CC3 content is published and kept up-to-date and complete to the best of my knowledge.
1.3 You may not sell, rent out, lease, license, distribute, market, exploit the Product or any of its parts commercially unless you obtained a license to do so from LowPolyCube.

2. Ownership

2.1 LowPolyCube shall at all times retain ownership of the application including, but not limited to, all
a) text, items of information, dialogues, slogans;
b) graphics, videos,
c) music, sounds,
d) fictional characters, names, objects; and
e) any other elements which are part of the software,
individually or in combination as installed on the device and all subsequent copies regardless of their form.
2.2 Exceptional cases may be those listed in section 1.2 of this EULA.

3. Responsibility and Limitation of Liability

3.1 You will use the software and the therein provided information at your own risk.
3.2 The software is provided on "an as" and "as available" basis. Therefore LowPolyCube does not not make any guarantees or warranties of any kind as to the
a) completeness, validity, security, utility, reliability nor actuality of the information provided in the software or the software itself; nor
b) suitability for a certain use; nor
c) the usability of the software on your device or terminal; as well as
d) your satisfaction
to the maximum extend permitted by law.

4. Period of Validity

4.1 The use of this software is only granted to you on the terms of this EULA. By purchasing, downloading, copying or otherwise using the the software you agree to be bound by its terms.
4.2 This EULA can be terminated by either you or LowPolyCube for any reason at any time. It will however immediately terminate upon your breach of these terms.
4.3 If this EULA is terminated all rights licensed to you under this EULA shall cease and you must immediately destroy all copies of the software as well as all of its components in your possession, custody or control.

5. Changes

5.1 LowPolyCube reserves the right to modify or discontinue, temporarily or permanently, the software(or any part/service thereof) with or without notice.
5.2 Changes to this EULA
5.2.1 LowPolyCube reserves the right to change these agreements at any time without giving reasons, even if those changes are not reasonable for the user, to complement present and future updates, to adjust to changes of the law or to complete or rephrase potentially misleading provisions, paragraphs, sentences or words of this or another agreement.
5.2.2 If you do not want to agree to the changes made to the EULA you have to terminate the agreement according to section 4.

6. Severability

If a clause of this Terms & Conditions is or becomes invalid, illegal or not enforceable in any jurisdiction, it shall not affect:
1) the validity or enforceability in that jurisdiction of any other provision of this Agreement; or
2) the validity or enforceability in other jurisdictions of that or any other provision of this Agreement
in the sense of § 306 of the BGB of German Law.
